2. If some other institute has the same name starting while searching for a name in a trademark official website,

In my opinion you will not get the trademark because it will resemble.

To answer your second query, you won't get the trademark.

Yes, there are two types of names to be filled while filing for GST: Legal Name and Trade Name. The income earn outside inida is taxable or not?
