Sir as mentioned earlier even if you withdraw the amount it's the liability to first deduct TDS on such winning and then pay you as such winning is in money form. If the person is not deducting TDS that's great and you need to pay tax at the end of your total income exceeds Rs. 250000.
If you need personal consultation or discussion you can call or mail me.

Brother it is the legal obligation of the poker operator to deduct TDS if amount of your earnings exceed the specified limit.
So withdrawing amount from your account would not change the legal obligation of poker Operator

CA Shrinidhi Rao       3 May 2019

If the poker already deducted TDS u/s 194B, you should file ITR. And no basic exemption limit for income from winnings. And it is immaterial whether you draw or not. Tax payable on this income at 30%+4% cess.

CA Vaibhav Mago       24 Apr 2019

Well, Mr Kushal it is upon the Poker operator to deduct 30% of your earnings if they exceed 10000.
In this case you cannot do anything.
You can file your tax return and claim excess tax (tds)deducted.

CA Naman Maloo       24 Apr 2019

No sir even if you withdraw 9999 then also the operator might deduct your TDS or report it anywhere so if its a big amount its better to file your income tax return properly. Also that 10000 limit applies to the operator even if you withdraw 9999 if he has credited an amount above 10000 he needs to deduct TDS.

My brother is a proprietor of small indoor advertising company, and his business turnover in FY 2018-2019 was 23,00,000. he was not registered with GST in last year. now, should he register with GST? if yes, under what scheme he should register with? composition or general?

Replies (1)

CA Naman Maloo       23 Apr 2019

He needs to apply for registration as his turnover exceeds 20 lakh and he can apply for composition scheme if ITC value is less and he need to pay tax @6%. If you need any help you can contact me on canamanmaloo@gmail.com or call me.
